While many people have heard of THC a significant amount of them don’t know that the federally regulated form of THC is Delta-9 THC. This is what Non-Medial Cannabis users traditionally have focused on. Delta-9 THC’s effects are commonly known these days so there’s usually little mystery where the Potato Chips disappeared to. Regardless, we have to consider official medical studies rather than Couch-Top Experimentation. The United States National Institute of Health’s National Library of Medicine, in 2004, published the following ill-effects of Delta-9 THC:

“Delta(9)-THC may induce unpleasant reactions such as disconnected thoughts, panic reactions, disturbing changes in perception, delusions and hallucinatory experiences.”

This is a clinical description of the ugly side of Marijuana (more specifically ∆9 THC) in one brief sentence. Why is this one sentence so important? What makes Delta-8 THC unique from Delta-9 THC?

How is Delta-8 Different from Delta-9?

Is Delta-8 THC Even Legal?

It’s been widely reported that Delta-8 is legal in the US. It’s not scheduled by the DEA and even has zero results when searched directly on their website. The now CBD Industry famous 2018 Farm Bill has no reference to Delta-8 and appears to only restrict Delta-9 in Hemp Products. Additionally, we’ve not seen any specific state legislation that would affect the legality of Delta-8 Products of any concentrations.

On December 22nd of the year 2020, attorney Philip Snow of Kight Law published an opinion of the legality of ∆8 and its products.

“Based on this definition of hemp, hemp-derived derivatives, extracts, cannabinoids, and isomers are included within the definition of lawful hemp. Because ∆8 is a cannabinoid that is derived from hemp, the analysis under states with this definition of hemp is that ∆8 is lawful.”


Does this mean ∆8 THC Products are legal? Although we believe so, and many other organizations – including many law firms – believe so, we recommend that you always conduct your own research.

Delta-8 THC Effects on the Human Body

Although there hasn’t been much clinical research on ∆8 there is an incredible amount of news about it. This is an important consideration because you have to take all published effects with a block of salt.

A very recent article published by KETV in Omaha has called Delta-8 “Weed Light” for its ability to produce a High similar to ∆9 THC with anecdotal reporting of a lower risk of Paranoia & Anxiety. More study is needed to confirm this. This new class of product is gaining in popularity because of this reported similarity to ∆9 THC Effects.
